TERMS
Distance contract or terms of delivery and return of goods, as well as the right of withdrawal (MK regulations).
These Terms are an integral part of the distance contract, which the parties, based on the order placed, conclude on the TĀLAVA SIA online marketplace. Breach of these Terms may form the basis for termination of the distance contract. The agreement is valid for an unlimited period of time.
By confirming the order, the client confirms that he has read, understood and agrees to the Terms of Use.
TERMS USED IN THE TERMS
Seller – the owner of the online marketplace veikails.talava.lv TĀLAVA SIA (registration No.44103088714, legal address Tālavas, Daudzeva, Aizkraukles novads, LV-5111, Latvia), which offers and sells goods to the client;
Customer – a natural or legal person who orders goods from TĀLAVA SIA, who has reached the age of 18 and has unlimited legal capacity and capacity to enter into contractual relations with TĀLAVA SIA;
Delivery – delivery of goods ordered by the Customer to the address specified in the Customer’s order or separately agreed with the Seller;
Shipment – a collection of goods purchased by the Customer, which the Customer receives at the address specified in the order.
2. ORDERING PROCESS
2.1. The Customer uses the TĀLAVA SIA website to order the desired goods and delivery services. When placing an order, the Customer does not need to register on the website, but when placing an order, accurate information about the Customer’s name, surname, delivery address and contact information must be provided. When placing an order, the Customer is responsible for providing correct, accurate and truthful information.
2.2. When placing an order, the Customer indicates the type and quantity of the goods to be ordered, making payment for the goods using the payment tools built into the online store. The Customer is sent an invoice corresponding to the order to the e-mail address, which is prepared electronically and is valid without a signature.
2.3. The Customer's personal data and additional information provided will be used to ensure the order, delivery, prepare the invoice and other obligations arising from this distance contract.
2.4. When placing an order, the Customer agrees to receive communication e-mails from TĀLAVA SIA related to the execution of the order (for example, order confirmation, sending the invoice, etc.).
2.5. The Customer has the opportunity to purchase alcoholic beverages only during the hours specified in the legislation of the Republic of Latvia, namely, from Monday to Saturday - from 10:00 to 20:00, on Sunday - from 10:00 to 18:00. At other times, the Customer may view the offer, but not make a transaction.
3. PAYMENTS
3.1. All prices indicated on the online store are in EUR, including value added and other taxes. By placing an order, the Customer agrees that additional fees may arise at the time of payment for the goods (for example, additional fees applied by the Customer's bank for performing a transaction).
3.2. In addition to the purchased goods, the Customer undertakes to cover the Delivery Fee for courier services to the address specified in the order in the amount of 7 EUR, if the total value of the goods (excluding delivery costs) for delivery is up to 59.99 EUR. The Delivery Fee of 7 EUR is not applied if the order value is 60.00 EUR or more. Free delivery for orders over 60 EUR does not apply to orders containing gift sets or seasonal hot drinks.
When placing orders with a Delivery Address outside the borders of the Republic of Latvia, the Seller agrees with the Customer on the delivery costs, which are calculated by courier services
3.3. The Customer can only pay with the payment methods indicated in the TĀLAVA SIA payment methods menu. The assembly of goods is started only after the full payment of the order on working days at 10:00-17:00.
3.4. Refund of money is made using the same payment method that the Customer used in the transaction.
3.5. As soon as the Customer pays for the order, an order confirmation and an electronic invoice are sent to the specified e-mail address.
3.6.The Customer pays for the order:
- by bank payment card
- by transfer to the bank account specified by the Seller, indicating the order number
- (other options, if necessary).
4. PREPARATION OF ORDERS
4.1. The Seller does everything and, to the extent possible, ensures the availability of all goods, however, when placing an order, the Customer is aware that situations may arise when the ordered goods may not be available (for example, seasonal products). The Seller informs the Customer about this in a timely manner and agrees on a refund for undeliverable goods or replaces them, in agreement with the Customer.
4.2.In the event of Force Majeure TĀLAVA SIA may temporarily or completely suspend online sales without prior notification to the Customer. In such cases, the Customer is reimbursed for the amount for undelivered orders within 14 (four)
4.3. The Seller shall ensure the collection of goods on working days between 10:00 and 17:00.
5. DELIVERY
5.1. The Seller shall deliver the goods ordered by the Client within the territory of Latvia via Omniva parcel machines or courier services, informing the Client in advance. Delivery and handover shall be organized no sooner than 6 hours after the order is placed (paid), from Monday to Saturday between 10:00 and 20:00, on Sundays between 10:00 and 18:00.
5.2. Delivery shall be made to the parcel machine or address specified by the Client in the order. If the Customer has not specified a parcel machine, the system automatically processes it at the nearest parcel machine to the address. The courier delivers the order to the main entrance of the specified address. After agreement with the courier, delivery is possible, for example, to the apartment door, however, TĀLAVA SIA cooperation partners always reserve the right to deliver the shipment only to the entrance door on the first floor of the building.
5.3.The scheduled delivery time of the shipment is 2-4 business days, depending on the workload of courier services (for example, during the pre-holiday period). If objective circumstances arise that delay the delivery of the shipment, the Seller undertakes to inform the Customer about it in a timely manner.
5.4.Delivery is provided via parcel machines and couriers on weekdays and Saturdays from 10:00 to 20:00, on Sundays from 10:00-18:00. The shipment can only be received by the ORDERER. When receiving the shipment, the Customer is obliged to present personal identification document (ID or passport) to confirm their identity. If the Customer cannot present a personal identification document at the time of delivery, the courier will not deliver the Shipment. In the event of an undelivered order, the Customer will be informed about this and, in order to receive a repeated delivery service, TĀLAVA SIA will prepare an additional invoice for the coverage of 7 EUR delivery costs, regardless of the order value.
5.5. TĀLAVA SIA also provides delivery of shipments within the European Union and the European Economic Area. To use this delivery method, the Customer places an order and indicates an address outside Latvia. After receiving the order, the Seller contacts the courier service and specifies the delivery costs, which are agreed with the Customer and an invoice is prepared for them.
5.6. Bulk orders (half pallets, pallets, etc.) are delivered by TĀLAVA SIA only upon prior agreement. To implement such a delivery, please contact the Seller by e-mail pasutijumi@talava.lv.
5.7. The Seller will do everything possible to ensure that the Customer's order is delivered within the specified time, however, it does not assume any responsibility for failure to comply with this time in part or in full, if this deviation occurred due to the Customer or other unavoidable circumstances.
5.8. If, upon receiving the shipment, the Customer has determined that the goods are damaged, the Customer shall inform TĀLAVA SIA in writing to the e-mail pasutijumi@talava.lv, attaching a full description of the damage and photographs of the damaged goods. The Seller will refund the money to the Customer's account from which the purchase was made within 14 (fourteen) days.
5.9. The goods are assembled and packed for safe transportation in cardboard boxes.
6. RIGHT OF REFUSAL
6.1. The Customer has the right to unilaterally exercise the right of withdrawal within 14 (fourteen) calendar days from the moment of receipt of the order, informing the Seller thereof. The right of withdrawal may be exercised as provided for in the laws and regulations of the Republic of Latvia and these Terms.
6.2. When refusing the Shipment, the Customer must deliver the goods to the address specified by the Seller at Rīgas iela 46, Gulbene in full and unused form. The Customer is responsible for the costs associated with the return of such orders. The return must be made within 5 (five) business days from the notification.
6.3.Article 12, Part Six of the Consumer Rights Protection Law of the Republic of Latvia stipulates that "the consumer is responsible for maintaining the quality and safety of the goods during the period of exercising the right of withdrawal". The Seller reserves the right to refuse the Customer the right of withdrawal or to withhold compensation in the event that the shipment and its contents are damaged, opened, not in the original packaging and set.
6.4. In the event of damage to the goods or other damage to the goods or their packaging, TĀLAVA SIA reserves the right to take legal action against the Customer, using the rights provided for in regulatory enactments.
6.5. TĀLAVA SIA shall, no later than 14 (fourteen) days from the date of actual return of the goods to the specified address (delivery or a document confirming dispatch), make a full refund of the amount of money to the bank account from which the order was paid. The refund is made using the same payment method that the Customer used in the transaction.
7. OTHER PROVISIONS
7.1. The Customer's personal data is used to identify the Customer and carry out all processes related to orders, deliveries and financial obligations arising from these Terms and Conditions and the distance contract for the use of TĀLAVA SIA goods purchase services. 7.2. By entering the necessary information when placing an order, the Customer confirms that he has read and agrees that the data provided by him is used so that the Seller can accept the Customer's order and deliver the goods in accordance with the requirements of the legislation of the Republic of Latvia. By entering information, the Customer agrees that notifications related to the processing of the order will be sent to the specified e-mail address.
7.3. The Seller TĀLAVA SIA may unilaterally make changes to these Terms.

7.5. The Terms have been prepared in accordance with and are governed by the laws and regulations of the Republic of Latvia, subjecting all disputes to the courts of the Republic of Latvia.

8. REFUSAL RULES
You can cancel your order at the time of delivery by handing over the entire order or certain items to the courier. Please fill out the withdrawal form.
You can exercise your right of withdrawal within 14 days of receiving your order by unilaterally canceling the order/item. To do this, please fill out the withdrawal form and send it to pasutijumi@talava.lv as soon as possible. You can exercise your right of withdrawal in the cases specified in regulatory enactments.
If you received a product that is damaged/poor quality or does not match the ordered one, and you discovered this after the courier left, please inform us by sending a photo of the damaged/non-conforming product to info@talava.lv. If such a request is submitted within 72 hours after receiving the product, we will refund the customer or provide a discount for the next purchase.
In the above cases, the money for the returned products, damaged/poor quality or non-conforming products, will be transferred to your bank account from which the order was made within 5 (five) business days after the date of return of the product.
In the event of a return or exchange of goods, the delivery fee for the order will not be refunded or reimbursed.
